1. Introduction
These Jobs Board Terms ("Terms") govern the use of the jobs and work features on the Only Farmers platform ("Platform"), including job postings by Farmers, work profiles created by users, and messaging between Farmers and applicants. These Terms supplement the Only Farmers Terms & Conditions and all other documents at onlyfarmers.co.uk/legal.
By posting a job, creating a work profile, or applying for a position through the Platform, you agree to these Terms.
2. Only Farmers' Role
Only Farmers provides a jobs board feature that allows Farmers to advertise available work and users to browse, apply for, and express interest in those opportunities. Only Farmers acts as a noticeboard only. Only Farmers is not:
- An employer, employment agency, or employment business within the meaning of the Employment Agencies Act 1973.
- A party to any employment contract, worker agreement, or engagement between a Farmer and any person who finds work through the Platform.
- Responsible for the terms, conditions, pay, hours, safety, or any other aspect of any work arrangement entered into between a Farmer and a worker.
Only Farmers does not vet, endorse, or guarantee any job posting, Farmer, or applicant. The jobs board is a communication tool only.
3. Posting a Job
Farmers may post job listings on the Platform. Each job posting must:
- Accurately describe the role, duties, location, expected hours, and duration (permanent, seasonal, or ad hoc).
- State the pay rate or salary (or state that it is negotiable). Where the role would be subject to the National Minimum Wage or National Living Wage, the rate offered must meet or exceed the applicable legal minimum for the worker's age band.
- State any minimum age requirement for the role. Jobs involving hazardous activities (including work with heavy machinery, chemicals, or livestock handling in confined spaces) must not be offered to persons under 18.
- Comply with the Equality Act 2010 and the Nondiscrimination Policy. Job postings must not discriminate on the basis of any Protected Characteristic.
- Comply with all applicable employment law, including the Employment Rights Act 1996 and the Working Time Regulations 1998.
Only Farmers reserves the right to remove any job posting that does not meet these standards or that we reasonably believe to be misleading, illegal, or in breach of these Terms.
4. Applying for Work
Users may create a work profile on the Platform to showcase their experience, skills, availability, and location. Work profiles are visible to Farmers who are looking for help.
Users may also apply for specific job postings by messaging the Farmer through the Platform's messaging system. All initial communication must take place through the Platform. After an introduction has been made, the Farmer and applicant may exchange direct contact details to arrange further discussions, interviews, or trial shifts.
Users aged 16 and 17 may apply for work through the Platform. However, Farmers are solely responsible for ensuring compliance with the Working Time Regulations 1998 (which impose limits on young workers' hours, night work, and rest periods) and the Management of Health and Safety at Work Regulations 1999 (which require a specific risk assessment before a young person starts work). In the agricultural sector specifically, Farmers must also comply with the restrictions in the Children and Young Persons Act 1933 and the Agriculture (Safety, Health and Welfare Provisions) Act 1956, which prohibit young workers from operating or riding on certain agricultural machinery, working with specified pesticides, and performing other hazardous tasks. Farmers must check local authority bylaws for any additional restrictions on young workers in their area.
5. Employment Relationship
Any work arrangement entered into between a Farmer and a worker is a direct relationship between those parties. Only Farmers is not a party to that arrangement. The Farmer is solely responsible for:
- Determining the employment status of the worker (employee, worker, or self-employed) and complying with the associated legal obligations.
- Issuing a written statement of employment particulars (where required under the Employment Rights Act 1996).
- Paying at least the National Minimum Wage or National Living Wage for the worker's age band.
- Deducting and paying income tax and National Insurance contributions through PAYE (where the worker is an employee or falls within off-payroll working rules).
- Holding Employers' Liability insurance (minimum £5,000,000, as required by the Employers' Liability (Compulsory Insurance) Act 1969) where the worker is an employee.
- Conducting right-to-work checks in accordance with the Immigration, Asylum and Nationality Act 2006.
- Providing a safe working environment and complying with the Health and Safety at Work etc. Act 1974.
- Carrying out a young person risk assessment before any worker aged 16 or 17 starts work, as required by the Management of Health and Safety at Work Regulations 1999.
- Complying with the Working Time Regulations 1998, including rest breaks, maximum weekly hours, and the additional protections for young workers.
- Complying with auto-enrolment pension obligations where applicable.
- Where employing a young person who is still of compulsory school age (under 16 in most cases, or under 18 where still in full-time education), notifying the relevant local authority as required by local bylaws on child employment.
- Where the work falls within the scope of the Gangmasters (Licensing) Act 2004, holding a valid GLAA licence.
Only Farmers does not verify whether Farmers comply with these obligations and accepts no liability for any failure to do so.
6. Modern Slavery & Labour Exploitation
Agriculture is recognised by the Gangmasters and Labour Abuse Authority (GLAA) and the UK Government as a sector with elevated risk of labour exploitation. All Farmers who post work opportunities on the Platform must:
- Comply with the Modern Slavery Act 2015 and ensure that no form of forced labour, debt bondage, human trafficking, or labour exploitation takes place in connection with any work arranged through the Platform.
- Not confiscate or retain any worker's identity documents, travel documents, or personal property.
- Not require workers to live in accommodation controlled by the Farmer as a condition of work, unless the accommodation meets all applicable standards and is offered on genuinely voluntary terms at a fair and transparent rent.
- Hold a GLAA licence where the work falls within the scope of the Gangmasters (Licensing) Act 2004 (which includes agricultural work, shellfish gathering, and associated processing and packaging).
If you suspect that a work arrangement facilitated through the Platform involves labour exploitation, modern slavery, or any form of abuse, report it immediately to safety@onlyfarmers.co.uk. Only Farmers will refer credible reports to the GLAA and/or the police. You can also report concerns directly to the Modern Slavery Helpline on 08000 121 700.
7. Payments
At launch, Only Farmers does not process payments between Farmers and workers for work arrangements. All pay is agreed and settled directly between the Farmer and the worker. Only Farmers has no involvement in, and no liability for, the payment of wages, salaries, or any other remuneration.
Only Farmers reserves the right to introduce a payment processing feature for work arrangements in the future. If and when this is introduced, Only Farmers will reassess its regulatory position under the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003 before launch, and will publish separate terms governing that feature.
8. Prohibited Conduct
You must not use the jobs board to:
- Post fraudulent, misleading, or fictitious job listings.
- Offer work that is illegal, exploitative, or that pays below the applicable National Minimum Wage.
- Discriminate against applicants on the basis of any Protected Characteristic.
- Require applicants to pay a fee, deposit, or advance payment as a condition of employment or engagement. This is prohibited under Regulation 26 of the Conduct of Employment Agencies and Employment Businesses Regulations 2003 (which applies by analogy even where Only Farmers is not itself an employment agency). The parties acknowledge and agree that the Conduct Regulations are not intended to, and do not, apply to the relationship between Only Farmers, Farmers, and applicants, or to Only Farmers' role as a noticeboard.
- Solicit personal data from applicants beyond what is reasonably necessary for the role (for example, requesting bank details or National Insurance numbers before an offer has been made).
- Offer work to under-16s. The minimum age for work on the Platform is 16.
- Use the jobs board to advertise non-agricultural or unrelated commercial activities.
9. Liability & Disclaimer
Only Farmers does not guarantee the accuracy, legality, or suitability of any job posting or applicant profile. Only Farmers is not liable for any loss, injury, dispute, or claim arising from any work arrangement entered into between a Farmer and a worker, including (without limitation) disputes over pay, working conditions, employment status, dismissal, or workplace accidents.
Farmers indemnify Only Farmers against any claims arising from their role as employer or engager of any person who finds work through the Platform, in accordance with the indemnity provisions in the Farmer Onboarding Agreement.
10. Data Protection
Personal data collected through the jobs board (including work profiles, job applications, and messages) is processed in accordance with our Privacy Policy. Farmers who receive personal data from applicants through the jobs board are independent data controllers for that data and must process it in accordance with the UK GDPR and the Data Protection Act 2018.
Farmers must not retain applicant personal data longer than is necessary for the recruitment process and must delete it if the applicant is not engaged, unless the applicant gives separate consent to their data being retained for future opportunities.
